Purchase Terms and Conditions
TERMS AND CONDITIONS
By purchasing an instrument from Melody Mender, the Customer acknowledges that they have read, understood, and agreed to these Terms and Conditions. The Customer’s click, or other affirmative action constitutes acceptance of these Terms and Conditions and is considered equivalent to a signed agreement, serving as the Customer’s consent to be legally bound to the fullest extent permitted by law.
TRIAL PERIOD
A seven (7) day trial period is included with every instrument purchase and begins on the date the Customer takes physical possession of the instrument. All accessory purchases are final and cannot be returned or exchanged.
To request a return, the Customer must notify Melody Mender in writing within the seven (7) day trial period by email at melodymender@gmail.com. Returned instruments must be in the same condition as received.
Melody Mender reserves the right to deny any return if the instrument shows signs of damage, misuse, alteration, or unauthorized modification.
Approved returns will be refunded to the original method of payment, excluding any shipping, handling, or transaction fees, within a reasonable time following inspection of the returned instrument.
3-MONTH WARRANTY OF WORKMANSHIP
This warranty is provided by Melody Mender and warrants the musical instrument against defects in workmanship for a period of three (3) months from the original date of purchase.
During the warranty period, any parts found to be defective due solely to workmanship will be repaired or replaced at no cost to the Customer, at the sole discretion of Melody Mender. Melody Mender is the sole service provider for this warranty. Repair or replacement shall be the Customer’s sole and exclusive remedy under this warranty.
Exclusions
This warranty does not cover:
Damage resulting from customer negligence, misuse, abuse, improper handling, improper storage, or accidents.
Normal wear and tear.
Damage caused by unauthorized repairs, modifications, or alterations.
Environmental damage, including but not limited to exposure to extreme temperatures, humidity, or liquids.
This warranty applies only to defects in workmanship and does not extend to damage or failure resulting from factors outside Melody Mender’s control.
Proof of purchase may be required to obtain warranty service. This warranty is non-transferable and applies only to the original purchaser.
Except as expressly stated herein, no other warranties, express or implied, including any implied warranties of merchantability or fitness for a particular purpose, are provided, to the extent permitted by law. Melody Mender shall not be liable for any incidental or consequential damages, including but not limited to loss of use, loss of income, or performance interruption, arising from the use or inability to use the instrument, to the extent permitted by law.
The Customer is responsible for any shipping, transportation, or delivery costs associated with warranty service unless otherwise agreed to in writing by Melody Mender.
GOVERNING LAW
These Terms and Conditions shall be governed by and construed in accordance with the laws of the Minnesota, without regard to conflict-of-laws principles.
SEVERABILITY
If any provision of these Terms and Conditions is found to be invalid, illegal, or unenforceable, the remaining provisions shall continue in full force and effect.
